PERJANJIAN KONTRAK KERJA


Perjanjian ini dibuat dan ditantandatangani pada ______ hari _____, 20__, oleh dan diantara _______ ("pihak pertama"), dan _______ ("pihak kedua"). Kedua belah pihak menyatakan bahwa:


A. Pihak pertama yang bergerak dibidang ____________ dan berkantor di ________.

B. Pihak pertama bersedia dipekerjakan oleh pihak pertama, dan pihak pertama akan mempekerjakan pihak pertama, berdasarkan syarat-syarat dan ketentuan-ketentuan selanjutnya. Berdasarkan alasan yang telah ditetapkan di atas, dan dengan pertimbangan yang akan ditetapkan dalam perjanjian ini atas kesepakatan-kesepakatan bersama dan perjanjian-perjanjian bersama kedua pihak dengan ini, pihak pertama dan pihak kedua sepakat dan setuju hal sebagai berikut:


1. PERJANJIAN PIHAK PERTAMA DAN PIHAK KEDUA
Dengan ini pihak pertama mempekerjakan pihak kedua sebagai _______ (10)_______ berkantor yang telah disebutkan, dan pihak kedua bersama ini menerima dan menyetujui pekerjaan tersebut.

2. URAIN KEWAJIBAN-KEWAJIBAN PIHAK KEDUA
Persoalan pengawasan dan mengikuti perintah-perintah, anjuran, dan arahan pihak pertama, pihak kedua harus melaksanakan tugas-tugas tersebut sebagaimana biasanya dilaksanakan oleh orang yang menduduki jabatan serupa di perusahaan-perusahaan atau usaha-usaha lainya atau yang bentuknya serupa seperti yang dipekerjakan oleh pihak pertama.
Pihak kedua harus menerima juga dan pelayanan-pelayanan yang tidak ada hubungannya dan yang tidak berkaitan dengan tugas utama atau sebagaimana mungkin ditugaskan kepada pihak pertama.

3. TATA CARA PELAKSANAAN TUGAS-TUGAS PIHAK KEDUA
Pihak kedua akan selalu setia, tekun, dan sesuai kemampuan, pengalaman , dan bakatnya, melakukan tugas-tugas yang munkin dibutuhkan dirinya dengan mematuhi syarat-syarat yang tersurat dan tersirat didalam perjanjian ini, yang memuaskan pihak pertama. Seperti tugas-tugas yang akan diterima dikantor yang disebutkan diatas dan di tempat-tempat lainnya sebagaimana yang pihak pertama meminta dengan baik atau demi kepentingan-kepentingan, kebutuhan-kebutuhan, usaha, dan kesempatan-kesempatan yang pihak pertama akan meminta atau menganjurkannya.

4. JANGKA WAKTU PEKERJA
Jangka waktu pekerja hanya sampai_____ tahun, dimulai pada _____,19__, dan diakhiri pada ____,19__, warga negara, akan tetapi, berhak mengakhiri bagaimanpun sebaliknya dalam hal ini.

5. GAJI TAMBAHAN:ONGKOS TAMBAHAN
Pihak pertama akan membayar pihak kedua dan pihak kedua setuju menerima dari pihak pertama, pembayaran penuh untuk pelayanan-pelayana pihak kedua dibawah ini, gaji tambahan sejumlah ____ Dollars ($_____) pertahun, dibayar ___.sebagai tambahan
yang terdahulu, pihak pertama akan membiayai untuk pihak kedua dan semua keperluan, kebutuhan, dan pengeluaran yang biasa dipakai selama perjalanannya dan demi kepentingan yang diperintahkan pihak oleh pihak pertama secara langsung.

6. KEPENTINGAN-KEPENTINGAN JANJI SETIA PIHAK KEDUA KEPADA PIHAK KEDUA
Pihak pertama harus tekun, perhatian, pengetahuan, dan sedikit trampil dan hanya untuk kepentingan usaha-usaha dan kepentingan-kepentingan pihak pertama, dan pihak pertama berhak untuk menerima pendapatan-pendapatan, penghasialan-penghasilan, keuntungan-keuntungan, atau penghasilan-pengsilan lainnya atau suatu transaksi dan lain-lain, layanan-layanan, dan penyemangat pihak kedua. Pihak kedua tidak boleh meragukan persetujuan-persetujuan persyaratan ia pada ketidak tertarikan dalam hal tersebut, secara langsung ataupun tidak langsung, bentuk lainnya, penampilan atau prilaku sebagai rekan kerja, teman kantor, direktur, pemegang saham, penasihat, pekerja atau dalam bentuk kapasitas yang lain, usaha yang serupa dengan usaha pihak pertama atau suatu perdagangan, kecuali tidak ada isi yang tercantum didalam undang-undang untuk pencegahan atau membatasi pihak kedua untuk berinvestasi atau membatasi hak karyawan untuk berinvestasi, surplus dana di modal saham atau dari setiap perusahaan atau pengamanannya tersebut milik publik atau secara teratur diperdagangkan di bursa, publik apapun didalam undang-undang ini yang terkandung dianggap untuk mencegah karyawan berinvestasi atau membatasi karyawan untuk berinvestasi , surplus dana dengan perumahan mewah .



EMPLOYMENT AGREEMENT

This Agreement made and entered into this ______ day of _____, 20 __, by and between _______ (“employer”), and ______(“employee”). The parties recite that:

A. Employer is engaged in ____________ and maintains business
premises at _________

B. Employee is willing to be employed by employer, and employer is willing to employ employee, on the terms and conditions hereinafter set forth. For the reasons set forth above, and in consideration of the mutual covenants and
promises of the parties hereto, employer and employee covenant and agree as follows:

1. AGREEMENT TO EMPLOY AND BE EMPLOYED
Employer hereby employs employee as _______(10)________ at the above-mentioned premises, and employee hereby accepts and agrees to such employment.
2. DESCRIPTION OF EMPLOYEE'S DUTIES
Subject to the supervision and pursuant to the orders, advice, and direction of employer, employee shall perform such duties as are customarily performed by one holding such position in other businesses or enterprises of the same or similar nature as that engaged in by employer.
Employee shall additionally render such other and unrelated services and duties as may be assigned to him from time to time by employer.
3. MANNER OF PERFORMANCE OF EMPLOYEE'S DUTIES
Employee shall at all times faithfully, industriously, and to the best of his ability,experience, and talent, perform all duties that may be required of and from him pursuant to the express and implicit terms hereof, to the reasonable satisfaction of employer. Such duties shall be rendered at the above mentioned premises and at such other place or places as employer shall in good faith require or as the interests, needs, business, and opportunities of employer shall require or make advisable.
4. DURATION OF EMPLOYMENT
The term of employment shall be_____years, commencing on ______,19__, and terminating _____,19 __, subject, however, to prior termination as otherwise provided herein.
5. COMPENSATION; REIMBURSEMENT
Employer shall pay employee and employee agrees to accept from employer, in full payment for employee's services hereunder, compensation at the rate of ____ Dollars($______) per annum, payable ___. In addition to the
foregoing, employer will reimburse employee for any and all necessary, customary, and usual expenses incurred by him while traveling for and on behalf of the employer pursuant to employer's directions.
6. EMPLOYEE'S LOYALTY TO EMPLOYER'S INTERESTS
Employee shall devote all of his time, attention, knowledge, and skill solely and exclusively to the business and interests of employer, and employer shall be entitled to all benefits, emoluments, profits, or other issues arising from or incident to any and all work, services, and advice of employee. Employee expressly agrees that during the term hereof he will not be interested, directly or indirectly, in any form, fashion, or manner, as partner, officer, director, stockholder, advisor, employee, or in any other form or capacity, in any other business similar to employer's business or any allied trade, except that nothing herein contained shall be deemed to prevent or limit the right of employee to invest any of his surplus funds in the capital stock or other securities of any corporation whose stock or securities are publicly owned or are regularly traded on any public exchange, nor shall anything herein contained by deemed to prevent employee from investing or limit employee's right to invest his surplus funds in real estate.
